Progressive Imaging & Consulting Assist With Rule 26 Meet and Confer Computer Forensics

In late 2011, Progressive Imaging & Consulting (PIC) was contracted to assist with the Rule 26 meet and confer scheduled by a southeastern Wisconsin law firm.  PIC serves two roles in a Rule 26 meeting.  First, we answer questions that the two parties have as they develop strategies to locate and access data that will serve as evidence in the legal dispute. It is the responsibility of the opposition’s lawyers to bring a computer forensic expert of their own to the Rule 26 Meet and Confer. PIC provides information for both parties concerning computer and data storage and retrieval concepts.  However, our stated goal is to provide any and all advantages that may be won through the meet and confer process to our client. Second, PIC works relentlessly to provide our clients the greatest opportunity to harvest the data they need to prevail in their legal dispute.

In the PIC Imaging case mentioned above, the opposition seemed confident that all pertinent data was in a small number of predefined locations, and assured our client that their tightly defined data retention policy had almost entirely eliminated data from the responsive date range. On the advice of J. Church, CCE from Progressive Imaging, our client persisted, compelling the other side to expand their very narrow listing of data locations. Though the list of prospective locations was only slightly expanded, PIC was now allowed to acquire data from additional locations that Church thought would yield results.
